The Board of Adjustment of the City of Wildwood will hold a public hearing on Thursday, September 21, 2023, which will begin at 6:30 p.m., at Wildwood City Hall, in the City Hall Chambers, 16860 Main Street, Wildwood, Missouri 63040, and via the online meeting platform (Zoom).  Written comments are encouraged and can be submitted via the City’s website until Wednesday, September 20, 2023, at 5:00 p.m. (CST).  All comments submitted for these purposes will become part of the record, pertinent to the applicable case number, and be promptly provided to the Board Members for their review.  

The purpose of this hearing is to consider requests for variances to certain Zoning Ordinance regulations or interpretations of their intent made by the Director of Planning relating to the individual properties identified below. Please review the individual notices of publications pertaining to your petition of interest for information relating to it.   To report any inaccuracies in the text or seek further information about these requests, please contact the Department of Planning and Parks at (636) 458-0440, prior to the hearing date. At this public hearing, the following requests will be presented to the Board of Adjustment for consideration and action:

I.

B.A. 19-23 Robert Kelly, 2531 Eatherton Road, Wildwood, Missouri 63040

– requests an exception to the Business Signs – Attached to Wall, for the purpose of maintaining a new business sign attached to the wall of the building located upon the property at 16929 Manchester Road (Locator Number 24V540020, Niere Acres – Lot 2, Wildwood Town Center), which would thereby authorize it to be retained without individually pinned-on lettering, as required by the Wildwood Zoning Ordinance. The size and height associated with this sign is identical to the previous sign at this location. These sign requirements are stipulated by Chapter 415.420 Sign Regulations for all “C” and “M” Districts of the City of Wildwood’s Zoning Ordinance, Chapter 415.190 C-8 Planned Commercial District Regulations of the City of Wildwood’s Zoning Ordinance, and C-8 Planned Commercial District Ordinance #11,577, approved in 1984 by St. Louis County.  This request is also to be reviewed by the Architectural Review Board at its September 14, 2023, meeting, as required by Chapter 415.400 Sign Regulations - General. (Ward Eight)

B.A. 20-23 Tom Dillion, 943 Old Eatherton Road, Wildwood, Missouri 63038, c/o Chris Matteo, Lombardo Homes, #4 Research Park Drive, St. Charles, Missouri 63304

– requests an exception to the Minimum Yard Requirements (General) for the purpose of constructing a new single family dwelling, along with an attached garage, upon the property located at 943 Old Eatherton Road (Locator Number 21W540093), which would authorize a front yard setback distance of twenty (20) feet in lieu of the required fifty (50) feet. This request is contrary to the requirements of Chapter 415.090 NU Non-Urban Residence District Regulations of the City of Wildwood Zoning Ordinance. (Ward Three)

B.A. 21-23 Tom Dillion, 943 Old Eatherton Road, Wildwood, Missouri 63038, c/o Chris Matteo, Lombardo Homes, #4 Research Park Drive, St. Charles, Missouri 63304

– requests an exception to the Miscellaneous Regulations of the Zoning Ordinance, which states no accessory land use or development shall be established on a lot, until a primary activity or structure is in place on the same property, for the purpose of maintaining a permanent accessory dwelling, without first the establishment of a primary activity or structure, upon it, with said dwelling being located at 943 Old Eatherton Road (Locator Number 21W540093), thereby authorizing its use throughout the construction of the new single-family dwelling. This accessory dwelling is to be utilized by a family member as a mother-in-law unit to the primary single-family dwelling. This request is contrary to the requirements of Chapter 415.380 Miscellaneous Regulations and Chapter 415.090 NU Non-Urban Residence District Regulations of the City of Wildwood Zoning Ordinance. – requests an exception to the Accessory Dwelling Definition of the Wildwood Zoning Ordinance to permit the continued use (by a family member) of the existing single-family residence, as an accessory dwelling (mother-in-law unit), once the new single-family dwelling completes construction, but without meeting the conditions of such, including, but not limited to, shared utilities and infrastructure, and access between units for full use, upon the property located at 943 Old Eatherton Road (Locator Number 21W540093). This request is contrary to the requirements of Chapter 415.380 Miscellaneous Regulations, Chapter 415.030 Definitions, and Chapter 415.090 NU Non-Urban Residence District Regulations of the City of Wildwood Zoning Ordinance. V.

B.A. 22-23 Karen and Steven Bressler, 3124 Woods Road, Wildwood, Missouri 63038

– request an exception to the Minimum Lot Area Requirements for the purpose of maintaining the presence of fowl, upon the property located at 3124 Woods Road (Locator Number 25V140041, McGinnis Acres – Lot 2), which would authorize a three (3)-acre minimum lot area for a permitted farm use in lieu of the five (5)-acre minimum lot area requirement (note: the petitioner owns two (2) contiguous lots, which together are greater than six (6) acres in area). Accompanying this request is an application for reduction in the front yard setback distance for a swing set and fence enclosure from the fifty (50) foot required distance to no less than ten (10) feet from Woods Road right-of-way.  This request is contrary to the requirements of Chapter 415.090 NU Non-Urban Residence District Regulations of the City of Wildwood Zoning Ordinance. VI.

B.A. 23-23 Matthew Bejoy, 2849 Dardenne Links Drive, O’Fallon, Missouri 63368

- requests an exception to the Specific Yard Requirements and Exceptions for the purpose of constructing a covered deck, sunroom, and stairway, as attached accessory structures to a new single-family dwelling, upon the property situated at 600 Highway 109 (Locator Number 20W540092), thereby authorizing the construction of them at a setback distance of forty (40) feet in lieu of the required fifty (50) feet from the presently defined 100-year floodplain boundary. This request is contrary to the requirements of Chapter 415.070 ‘FP’ Floodplain District Regulations and Chapter 415.090 NU Non-Urban Residence District Regulations of the City of Wildwood Zoning Ordinance. (Ward One)

Notice is hereby given that the Board of Adjustment may also hold a closed meeting for the purpose of dealing with matters relating to one or more of the following: Legal Actions, Causes of Action, Litigation or Privileged Communications Between the City’s Representatives and its Attorneys [RSMO 610.021(1) 1994]; Lease, Purchase or Sale of Real Estate [RSMO 610.021 (2) 1994]; hiring, firing, disciplining or promoting employees by a public governmental body [RSMO 610.021 (3) 1994]; bidding specification [RSMO 610.021 (11) 1994]; sealed bids and related documents, until the bids are opened’ and sealed proposals and related documents or any documents related to a negotiated contract until a contract is executed, or all proposals are rejected [RSMO 610.021 (12) 1994]; and/or individually identifiable personnel records, performance ratings or records pertaining to employees or applicants for employment [RSMO 610.021 (13) 1994.]
